This privacy policy sets out the basis on which any personal data we collect from you, or that you provide to us, through including but not limited to our mobile application software, such as the PEEX mobile application, (“App) and our website(s) (“Services Site”), will be processed by us.

It is important that you read this privacy policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and is not intended to override them.

Powerchord Group Limited is the controller and responsible for your personal data (collectively referred to as "Powerchord", "we", "us" or "our" in this privacy policy.

Information we collect from you


Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data rendered anonymous in such a manner that identification of a person is no longer possible.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • IDENTITY DATA
    includes first name, last name, username or similar identifier, marital status, title, and gender.
  • CONTACT DATA
    includes billing address, delivery address, email address and telephone numbers.
  • FINANCIAL DATA
    includes bank account and payment card details.

    includes details about payments to and from you and other details of products and services you have purchased from us.
  • TECHNICAL DATA

    includes your username and password, purchases or orders made by you, your interests, preferences, and feedback.

    includes information about how you use our website, products and services.

    includes your preferences in receiving marketing from us and our third parties and your communication preferences.

We also collect, use and share
AGGREGATED DATA
such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is in its aggregated form not considered personal data in law when this data will not directly nor indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. How do we collect your personal data?

We use different methods to collect and process your data including through:

    You may give us your Identity Data, Contact Data, Profile Data and Financial Data by completing forms or corresponding with us. This includes personal data you provide when you:
    • Subscribe to marketing on our Service Site;

    • Register for a new user account;

    Each time you visit the Services Site or use our App and as you interact with both we will automatically collect Technical Data about your equipment, browsing actions and patterns.     We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) from whom we will receive personal data about you including:

  • Professional advisers acting as processors or controllers including lawyers, ac countants, bankers, auditors and insurers based in the United Kingdom who provide consultancy, banking, legal, insurance and accounting services.
  • HM Revenue & Customs (the United Kingdom’s tax, payments and customs authority), regulators and other authorities acting as processors or joint controllers based in the United Kingdom.

Where We store your personal data

The data that We collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. These staff may be engaged in the fulfilment of your request, order or reservation, the processing of your payment details and the provision of support services.

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
  • Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

All information you provide to us is stored on secure servers using cloud infrastructure provided by Microsoft Azure. Any payment transactions carried out by our chosen third-party provider of payment processing services will be encrypted using Secured Sockets Layer technology. Where We have given you (or where you have chosen) a password that enables you to access certain parts of the Services Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although We will do our best to protect your personal data, We cannot guarantee the security of your data transmitted to the Services Site; any transmission is at your own risk. Once We have received your information, We will use strict procedures and security features to try to prevent unauthorised access.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

Your Rights

No fee usually required

Product Safety Information

Please read these important safety and handling warnings before using the PEEX rX.

Important Safe Handling Information

  • The PEEX rX is fitted with a USB C port for charging and firmware updates. Charge only with provided USB lead via rX unit.
  • Only connect the USB cable to a USB computer port or a USB charger marked with the CE certification mark and the appropriate output rating. This is to ensure the device is charged safely.
  • The PEEX rX is supplied with a lanyard (and an optional extension) designed to fit comfort- ably around the neck. Whilst the lanyard features a magnetic safety clasp, care should be taken in use to avoid any risk of strangulation or injury as a result of entanglement.
  • The PEEX lanyard has magnetic parts which may attract metallic materials.
  • The PEEX receiver and lanyard should be cleaned with a dry cloth.
  • If you experience any irritation due to skin conditions or allergic reactions, stop using the PEEX receiver and consult your physician if symptoms are severe or persist. Do not use if wearing aggravates existing conditions.
  • The product is designed to be used with the earphones included with the PEEX rX. Whilst the design has been considered to manage excess cable, care should be taken to reduce the risks of entanglement.

  • The PEEX rX and the earphones included have been designed to provide safe sound pressure volumes in accordance with the European Union EN 50332-1:2013 standard. Initial maximum Sound Pressure Level (SPL) is therefore limited to 85dB(A) SPL. Users are required to select an override option, via the PEEX application, to de-limit the PEEX rX, which allows it to then reach a maximum level of 100dB(A) SPL.
  • To prevent possible hearing damage, do not listen at high volumes for long periods.
  • The PEEX rX is not waterproof. Immersion or excessive exposure to water may cause damage, malfunction and/or inoperability. In the event the PEEX rX comes in contact with water, clean immediately with a dry cloth.
  • The PEEX rX should operate normally in temperatures between 0° and 45° Celsius, with 5% to 95% non-condensing humidity. Only store in a dry and clean environment.
  • The PEEX rX is a wireless device and should be switched off in any location where you are advised to do so, e.g. in an aircraft; fuelling stations; places with explosive atmospheres etc.
  • The PEEX rX is designed and tested to comply with stringent radio emissions regulations. However, there is a risk of the device causing unexpected interference in other electronic equipment.
  • People with pacemakers are advised to maintain a separation of at least 15cm between a PEEX rX and their pacemaker.
  • Keep small parts out of reach of small children (especially those under 3 years old) as they may be a choking hazard.

Conformity

  • This device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) this device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.
  • EU Simplified Declaration of Conformity (No.18/01s): “Hereby, PowerChord Limited declares that the radio equipment type PWHH-RXFG is in compliance with Directive 2014/53/EU. The full text of the EU declaration of conformity is available at the following internet address: www.peex.live”

Important Battery Safety Information

  • The PEEX rX contains a built in Lithium-ion battery, improper use of which may cause a fire or explosion.
  • The battery is not user replaceable and should only be replaced by PowerChord or a service provider appointed by PowerChord.
  • Do not disassemble, customise or short-circuit the battery.
  • Do not pierce the battery pack casing with any sharp object; break it open, or step on it. Do not strike, throw or subject the battery pack to severe physical shock.
  • Do not place the battery pack in fire or expose to open flame, heat or direct sunlight for extended periods of time.
  • Do not recharge the battery in extremely hot conditions or near open flames.
  • If electrolyte comes into contact with the skin or eyes, flush the electrolyte immediately with fresh water and seek medical advice.

Warranty Information

  • PowerChord warrants this hardware product against defects in materials and workmanship 1 year from the date of purchase. This does not warrant against normal wear and tear, nor damage caused by accident or abuse.
  • If you are in need of technical support for our products, please contact PowerChord via support@peex.live
  • If your product is found to be faulty, damaged, of a quality unacceptable to our standard, and you are found to have a valid claim under this warranty, you will be entitled to a replacement product or refund. In this case, please discontinue use of the product immed-iately, and contact support@peex.live to report a fault.
  • There are no user serviceable parts inside the PEEX rX.
  • If the product is found to have been misused, modified or interfered with it may invalidate your limited warranty.
  • Warranty benefits are in addition to rights provided under local consumer laws. You may be required to furnish proof of purchase details or product information when making a claim under this warranty.

Environmental

  • The PEEX rX is manufac- tured in line with international best practices (RoHS) designed to protect the environment by minimising the use of hazardous materials.
  • Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health. Please check your local initiatives offering electrical waste disposal and recycling services before disposing of any electrical equipment or batteries.
  • Electrical equipment (including those marked with the crossed out wheeled bin symbol) and batteries must be disposed of separately from household waste.
  • If you’re buying a new PEEX rX, please contact support@peex.live and we will be happy to help recycle your old one for free.
